Terms of Service

Clawson Insurance Advisors ("CIA," "we," "us," or "our") is a DBA of Alpha Omega Insurance Agency, a Texas-licensed independent insurance agency (Texas Department of Insurance license number 19304).

These Terms of Service ("Terms") govern your use of our website, our lead and contact forms, and any quoting or referral services we provide. By using our website or submitting a request to us, you agree to these Terms.

1. Who We Are and What We Do

We are an independent insurance agency. That means:

  • We help you shop for insurance coverage by gathering your information and submitting it to insurance carriers we represent.
  • We are licensed to sell insurance throughout the State of Texas.
  • We are paid by the insurance carriers (typically through commissions) when a policy is placed, not by you directly. If we ever charge a separate fee, we'll tell you in advance.

We are not an insurance company. We do not underwrite, issue, or pay claims on insurance policies. The insurance carrier you choose does that.


2. Quotes, Coverage, and What's Actually Binding

This is important, so we'll say it plainly:

  • A quote is an estimate, not coverage. Premiums and terms shown in a quote are based on the information you give us and the carrier's current rates. They can change before binding.
  • No coverage is in place until a carrier issues a policy and accepts your premium. Submitting a lead form, scheduling a call, or even verbally agreeing to a quote does not put coverage in force.
  • You are responsible for keeping any current coverage active until your new policy is bound. Don't cancel an existing policy on the assumption that something else is in place — confirm in writing first.
  • Carriers can decline, modify, or non-renew coverage based on underwriting. We don't control those decisions.

If anything about your situation changes between when you give us information and when a policy is bound (an accident, a new driver, a move, a new vehicle, etc.), tell us. Withholding or misstating information can cause a claim to be denied or a policy to be voided by the carrier.


3. Your Information Must Be Accurate

When you submit a lead form, schedule a call, or share information for a quote, you agree that:

  • The information you give us is true and complete to the best of your knowledge.
  • You are at least 18 years old and have the legal authority to request insurance for the person, property, or vehicle in question.
  • You are not impersonating someone else.

If we learn that information you provided is materially inaccurate or that you don't have authority to act on the matter, we can stop working on your quote and notify any affected carrier.


4. Communications Consent

By submitting a lead form, you agree that we (or someone working on our behalf) can contact you by phone call, text message (SMS), and email about your insurance request, including using automated technology where applicable. You can opt out at any time as described in our Privacy Policy. Standard message and data rates may apply for text messages.

Consent to receive these communications is not a condition of buying insurance.


5. Website Use Rules

When using our website, you agree not to:

  • Use the site for any unlawful purpose
  • Submit false information, impersonate another person, or use the site on behalf of someone without their permission
  • Attempt to gain unauthorized access to our systems, accounts, or other users' information
  • Scrape, crawl, or harvest data from the site using automated tools
  • Upload viruses, malware, or other harmful code
  • Interfere with the operation of the site, including by overloading or attempting denial-of-service attacks
  • Reverse-engineer or copy the site's design or content for a competing service
  • Send spam, unsolicited promotions, or unrelated commercial messages through any contact form

We can suspend or block access to our site or services for anyone who violates these rules.


6. Intellectual Property

The content on our website — including text, graphics, logos, photos, video, layout, and the underlying code — is owned by Clawson Insurance Advisors / Alpha Omega Insurance Agency or our licensors and is protected by copyright and trademark law.

You may view and print pages for your personal, non-commercial use. You may not copy, republish, modify, distribute, or use our content for any commercial purpose without our written permission.

The "Clawson Insurance Advisors" name and logo are our trademarks. Other names and logos that appear on the site (such as those of insurance carriers or platform partners) belong to their respective owners.


7. Third-Party Links and Services

Our site or messages may include links to third-party sites — for example, an insurance carrier's portal, a payment processor, or an online quoting tool. We don't control those sites and aren't responsible for their content, accuracy, or practices.

Once you leave our site, you're subject to that third party's terms and privacy policy. Read them.


8. Disclaimer of Warranties

We do our best to be accurate and helpful, but we provide our website and services "as is" and "as available", without warranties of any kind, either express or implied. To the fullest extent allowed by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties about accuracy, completeness, reliability, security, or uninterrupted availability.

Nothing on our website is legal, tax, or financial advice. Insurance recommendations are based on the information you give us and your stated needs — they're not a substitute for reading your policy or consulting with a professional advisor where appropriate.


9. Limitation of Liability

To the fullest extent allowed by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. This includes lost profits, lost data, business interruption, or loss of goodwill.
  • Our total liability for any claim arising out of or relating to these Terms or our services is capped at the greater of (a) the commissions we received in connection with your policy in the twelve months before the claim, or (b) $100.
  • We are not liable for the actions, decisions, or omissions of any insurance carrier, including coverage decisions, claim handling, premium changes, or non-renewals.

Some jurisdictions don't allow certain limitations on liability, so parts of this section may not apply to you.


10. Indemnification

You agree to defend, indemnify, and hold harmless Clawson Insurance Advisors, Alpha Omega Insurance Agency, and our employees and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of (a) your violation of these Terms, (b) information you submitted that was false or that you didn't have permission to share, or (c) your misuse of our website or services.


11. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Subject to the arbitration clause below, any lawsuit must be filed in the state or federal courts located in Collin County, Texas, and you consent to the jurisdiction of those courts.


12. Dispute Resolution and Arbitration

Please read this section carefully — it affects how disputes between us are resolved.

If a dispute arises between you and us that we can't work out informally, you and we agree to resolve it through binding individual arbitration instead of in court, except as noted below.

  • Informal resolution first. Before starting arbitration, contact us using the information in Section 14 and give us at least 30 days to try to resolve the issue.
  • Arbitration rules. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in Collin County, Texas or by video conference, at your choice.
  • Individual basis only. Disputes will be resolved on an individual basis. You and we both waive the right to participate in a class action, class arbitration, or representative action.
  • Exceptions. Either of us can still (a) bring a claim in small-claims court if it qualifies, or (b) seek an injunction in court to protect intellectual property or stop unauthorized access to our systems.
  • Jury trial waiver. To the extent any dispute does end up in court, you and we both waive any right to a jury trial.

If any part of this arbitration section is found unenforceable, the rest still applies.


13. Changes to These Terms

We can update these Terms from time to time. When we do, we'll change the "Last updated" date at the top. Material changes will be highlighted on our website or sent to you by email if we have your address. Your continued use of the site or our services after changes are posted means you accept the updated Terms.
